These Website Terms and Conditions apply when you visit our website, create an account or purchase products from us.

Amaroso Boutique is operated by Amaroso Boutique Pty Ltd ATF The Owen Anderson Family Trust ABN 57 377 615 957. In these Terms and Conditions, we refer to Amaroso Boutique as “Amaroso Boutique”, “we”, “us” or “our”.

By using our website or placing an order, you agree to these Terms and Conditions. Please read them before making a purchase.

These Terms and Conditions should be read together with our Returns Policy, Privacy Policy and Cookies Policy.

Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other rights that cannot legally be excluded.

1. ORDERS

1.1 PLACING AN ORDER

When you place an order through our website, you are offering to purchase the products in your cart for the total price displayed at checkout.

By placing an order, you confirm that:

  • the information you provide is complete and accurate;
  • you are legally able to enter into a contract with us;
  • you are authorised to use the selected payment method;
  • you have reviewed the products, sizes, colours and quantities in your order;
  • you have provided the correct delivery address; and
  • you agree to these Terms and Conditions.

1.2 ORDER ACCEPTANCE

An order confirmation email acknowledges that we have received your order. It does not necessarily mean that we have accepted or are able to fulfil it.

Your order is accepted when we approve payment and begin processing the order. We may decline or cancel an order before dispatch where reasonably necessary, including where:

  • a product is unavailable or was incorrectly listed;
  • there is an error in the product description, price or promotion;
  • payment cannot be authorised or verified;
  • the order is identified as potentially fraudulent or unauthorised;
  • the order appears to have been placed for unauthorised commercial resale;
  • the delivery address is incomplete, invalid or outside an area we service;
  • the order breaches a purchase limit or promotional condition; or
  • we reasonably believe the order breaches these Terms and Conditions.

If we cancel an order after payment has been processed, we will refund the amount paid for the cancelled products to the original payment method.

1.3 PRODUCT AVAILABILITY

All products are subject to availability. Adding a product to your cart does not reserve it.

On rare occasions, a product may sell out before our inventory system is updated. If we cannot supply a product, we may cancel that item and refund the amount paid for it.

Where only part of an order is unavailable, we may dispatch the available products and refund the unavailable product unless we agree otherwise.

1.4 ORDER LIMITS AND RESELLING

We may apply reasonable limits to the quantity of a product that can be purchased by one customer, account, household, payment method or delivery address.

Our products are offered for personal use. You must not purchase products for unauthorised commercial resale, distribution or export without our prior written approval.

2. CHANGING OR CANCELLING AN ORDER

Our warehouse processes orders quickly. Once an order has been placed, we cannot guarantee that it can be changed or cancelled before dispatch.

This includes requests to change:

  • the delivery address;
  • the size, colour or quantity of an item;
  • the payment method;
  • the shipping method; or
  • the products included in the order.

You may contact us through the Contact Form immediately after placing your order. We will try to assist, but we cannot guarantee that your request will be received before the order is processed or dispatched.

If we cannot change or cancel your order, you may be able to return eligible products after delivery in accordance with our Returns Policy.

3. PRODUCTS

3.1 PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, videos, measurements, prices and other information displayed on our website are accurate.

Product information is provided as a general guide. Minor variations may occur between products and production runs, including variations in colour, print placement, pattern, texture, finish, measurements and detailing.

Unless expressly stated otherwise, accessories, footwear, jewellery or other items shown in styling photographs are not included with a product.

3.2 COLOUR AND DISPLAY

We make every effort to display product colours accurately. However, colours may appear differently depending on:

  • your device and screen settings;
  • screen brightness and colour calibration;
  • photographic lighting;
  • the surrounding environment; and
  • reasonable variations in materials and production.

A minor colour difference caused by screen display, lighting or ordinary product variation does not necessarily mean that a product is faulty or materially different from its description.

3.3 SIZING AND MEASUREMENTS

Sizing can vary between brands, styles and fabrics. A size label alone does not guarantee that every product in that size will fit in the same way.

Any size guide, model information or garment measurement is provided as a guide only. Measurements may vary slightly depending on the product, fabric, measuring method and production process.

It is your responsibility to review the product information and available size guidance before ordering. An item not fitting as expected is generally considered a change of mind rather than a product fault.

3.4 PRODUCT CARE

You must follow the care instructions provided with the product. Damage caused by misuse, incorrect washing, incorrect storage, alteration, excessive wear or failure to follow care instructions is not considered a product fault.

4. PRICES AND PAYMENT

4.1 PRICES

Unless otherwise stated, prices displayed for Australian customers are in Australian dollars and include GST where applicable.

Prices may differ between countries or markets due to currency conversion, taxes, duties, operational costs and local pricing. The price displayed at checkout before you submit your order is the price that applies to the order, subject to any obvious pricing error.

We may change product prices at any time. A later price reduction or promotion does not entitle you to a refund of the difference on a previous order.

4.2 PAYMENT

Full payment is required when an order is placed unless an approved third-party payment provider offers another arrangement.

Available payment methods are displayed at checkout and may vary by country, currency, device or order.

Payments may be processed by third-party payment providers. Your use of those services is also subject to the provider’s terms, conditions and privacy policy.

We are not responsible for interest, fees, account restrictions or other charges imposed by your bank, card provider or third-party payment provider.

4.3 PAYMENT AUTHORISATION

We may take reasonable steps to verify an order or payment. This may include requesting further information from you or cancelling an order that we reasonably consider high risk, fraudulent or unauthorised.

Providing requested information does not guarantee that an order will be approved.

4.4 PRICING ERRORS

We may correct genuine errors in product prices, shipping charges, promotions or other information displayed on our website.

If an obvious pricing or promotional error affects your order, we may contact you and offer you the choice of:

  • proceeding at the correct price; or
  • cancelling the affected product or order for a refund.

We will not charge a corrected higher price without your agreement.

5. PROMOTIONS AND DISCOUNT CODES

From time to time, we may offer sales, discount codes, promotional offers, gifts with purchase or other promotions.

Unless the promotion states otherwise:

  • only one discount code may be used per order;
  • discount codes cannot be combined;
  • a discount code must be entered at checkout before payment;
  • discounts cannot be applied retrospectively;
  • discounts do not apply to shipping charges;
  • minimum-spend requirements are calculated after other discounts;
  • excluded products, brands or categories may apply;
  • promotions are available only during the stated promotional period;
  • promotions are subject to product availability; and
  • discount codes have no cash value and cannot be exchanged for cash.

We may cancel, suspend or amend a promotion where reasonably necessary, including where an error, technical issue, fraud or misuse affects the promotion.

If a returned product causes an order to no longer meet the requirements of a promotion, the value of any refund or store credit may be adjusted to reflect the promotion actually retained.

Where a free gift was provided because an order met a promotional condition, the gift may also need to be returned if the qualifying products are returned. If the gift is not returned, its advertised value may be deducted from any store credit or refund where permitted by law.

6. GIFT CARDS AND STORE CREDIT

6.1 PURCHASED GIFT CARDS

Purchased gift cards can be redeemed through our online checkout and are subject to any terms displayed at the time of purchase.

Purchased gift cards will remain valid for at least the minimum period required by Australian law.

Gift cards:

  • are not legal tender or bank accounts;
  • cannot be redeemed for cash except where required by law;
  • cannot be used to purchase another gift card unless we allow it;
  • must be used before their applicable expiry date; and
  • may be used across multiple orders until the balance is exhausted.

6.2 STORE CREDIT

Store credit issued for an approved change-of-mind return is provided as an Amaroso Boutique gift card or store credit sent to the email address used when the return was lodged.

Store credit issued by Amaroso Boutique does not expire.

Store credit cannot be redeemed for cash or transferred back to the original payment method except where required by Australian law or where we agree otherwise.

Store credit may be used across multiple purchases until the balance is fully used.

6.3 KEEPING CODES SECURE

You are responsible for keeping gift card and store-credit codes secure. Treat them like cash.

We are not responsible for a code being used without your permission where the code was lost, shared, forwarded or accessed through your email account, except to the extent required by law.

7. SHIPPING AND DELIVERY

7.1 SHIPPING CHARGES

Available shipping methods, charges and any free-shipping threshold are displayed on our website or at checkout.

The applicable shipping charge is based on factors including the delivery destination, order value, selected service and current shipping offer.

7.2 DISPATCH

Orders are dispatched on business days, excluding weekends and public holidays observed by our warehouse.

Orders placed before our advertised dispatch cut-off are generally dispatched on the same business day. Orders placed after the cut-off are generally dispatched on the next business day.

Same-day dispatch is a processing target, not a guaranteed delivery date. Dispatch may be delayed during major sales, promotional periods, public holidays, extreme weather, carrier disruptions or other unusually busy periods.

7.3 DELIVERY ESTIMATES

Any delivery date or timeframe displayed on our website, at checkout or in an email is an estimate only.

Delivery estimates may be affected by the delivery location, carrier network, weather, peak periods, public holidays, customs processing, incorrect address details and other circumstances outside our reasonable control.

Nothing in this section limits any rights you may have under the Australian Consumer Law where delivery does not occur within a reasonable time.

7.4 DELIVERY ADDRESS

You are responsible for providing a complete and accurate delivery address.

We are not responsible for delays, return-to-sender charges or delivery issues caused by an incorrect, incomplete or outdated address provided by you, except to the extent caused by us or otherwise required by law.

If a parcel is returned to us because of an incorrect address, failed delivery, refusal, non-collection or other circumstance not caused by us, we may require payment of further shipping charges before sending it again.

7.5 SIGNATURE AND AUTHORITY TO LEAVE

We may send orders using a signature-on-delivery service.

If you request or authorise safe drop, authority to leave or another delivery preference directly with the carrier, you accept the additional risks associated with that delivery instruction.

If tracking shows that a parcel has been delivered but you cannot locate it, you must first:

  • check the delivery location and surrounding safe areas;
  • check with other members of the household, neighbours or building management;
  • review any delivery photograph or notification; and
  • contact the carrier and lodge a delivery enquiry.

You may then contact us through our Contact Form with your order number and the carrier enquiry details so we can assist where appropriate.

7.6 DELIVERY DELAYS

Once an order has been handed to the carrier, the carrier controls the physical delivery process. We will provide reasonable assistance with a delayed or missing parcel, but we may need to wait for the carrier to complete an investigation.

A carrier delay does not automatically entitle you to keep the products and also receive a refund. Any remedy will depend on the circumstances and your rights under applicable law.

7.7 INTERNATIONAL ORDERS

International shipping is available only to destinations shown at checkout. We may decline an international order where we cannot reasonably ship to the nominated destination.

International orders may be subject to import duties, taxes, customs fees, brokerage charges or other government charges imposed by the destination country.

Unless expressly stated otherwise at checkout, these charges are not included in the product or shipping price and are your responsibility.

We do not control customs processing and are not responsible for delays or charges imposed by customs authorities. Refusing to pay an import charge does not automatically entitle you to a refund of shipping costs or other costs incurred in returning the parcel.

8. CHANGE-OF-MIND RETURNS

We offer eligible change-of-mind returns in addition to your rights under the Australian Consumer Law.

A change of mind includes situations where:

  • the item does not fit as expected;
  • you selected the wrong size, colour or product;
  • you no longer want the item;
  • you do not like the style on you;
  • you expected a different fit or appearance; or
  • you found the item or a similar item at a different price.

Change-of-mind returns are subject to our Returns Policy. The Returns Policy forms part of these Terms and Conditions.

8.1 RETURN PERIOD

An eligible change-of-mind return must be lodged and returned within 30 days of delivery, in accordance with the instructions in our Returns Portal.

The 30-day return period applies only to our voluntary change-of-mind return policy. It does not affect or limit any rights or remedies you may have under the Australian Consumer Law.

Products received outside the change-of-mind return period may be refused and returned to you at your cost.

8.2 RETURN CONDITION

To be accepted for a change-of-mind return, a product must be:

  • unworn and unused other than being tried on;
  • unwashed;
  • unmodified;
  • free from stains, marks, makeup, fake tan, perfume, deodorant, pet hair and odours;
  • returned with all original tags attached;
  • returned with any original product packaging where applicable; and
  • otherwise in its original saleable condition.

Shoes must be returned with their original box in saleable condition. Do not attach tape, labels or writing directly to the shoe box.

Products identified as Final Sale, Clearance or otherwise marked as non-returnable are not eligible for a change-of-mind return where this was clearly disclosed before purchase. This does not affect your rights under the Australian Consumer Law if the product fails to meet a consumer guarantee.

Any hygiene-related exclusions or product-specific exclusions shown on the product page or in our Returns Policy also apply to change-of-mind returns.

8.3 STORE CREDIT

Approved change-of-mind returns are issued as an Amaroso Boutique store credit unless the replacement-order refund process in clause 9 applies.

The store credit will generally equal the amount paid for the accepted returned product after discounts, excluding original shipping charges, return-label charges and other non-refundable costs.

8.4 RETURN SHIPPING

Return shipping for a change-of-mind return is your responsibility.

Where we provide a return label, the applicable label cost may be deducted from your store credit or refund as disclosed through the Returns Portal.

You remain responsible for the return until it is received by us. We recommend retaining your tracking number and lodgement receipt.

8.5 REJECTED RETURNS

We inspect returned products before approving a return.

A product that does not meet the change-of-mind return conditions may be refused. If a return is refused, we may require you to pay the cost of sending the product back to you.

Nothing in this clause limits your rights in relation to a product that fails to meet a consumer guarantee under the Australian Consumer Law.

9. REPLACEMENT ORDERS AND REFUNDS

We do not hold products while a return is being sent back or processed. Because products can sell quickly, the best way to secure another size, colour or style is to place a new order.

If you would prefer a refund instead of store credit for an eligible change-of-mind return, you may use our replacement-order process:

  1. Place a new order for your replacement product. The replacement may be a different product, size, colour or price.
  2. Lodge the original product through our Returns Portal within the applicable return period.
  3. Send the original product back in accordance with our Returns Policy.
  4. Contact us through the website Contact Form and provide both the original order number and the new replacement order number.

Once the returned product has been received, inspected and approved, we may refund the original payment method up to the value of the new replacement order.

If the replacement order is worth less than the accepted return:

  • the refund will generally be limited to the amount paid for the replacement order; and
  • any remaining eligible return value will be issued as store credit.

If the replacement order is worth more than the accepted return, you remain responsible for the difference.

A new order must be genuinely placed and paid for. An order that is cancelled, refunded, disputed or itself returned may no longer qualify as a replacement order.

Return conditions, return-label costs and product exclusions continue to apply. Placing a replacement order does not guarantee acceptance of an ineligible return.

10. FAULTY, INCORRECT OR MISDESCRIBED PRODUCTS

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy where a product:

  • is faulty or unsafe;
  • is not of acceptable quality;
  • is substantially different from its description or sample;
  • does not do what we represented it would do; or
  • is not fit for a disclosed purpose that you reasonably relied on.

10.1 REPORTING A PROBLEM

If you believe you have received a faulty, incorrect or misdescribed product, please contact us through our Contact Form.

Please include:

  • your order number;
  • the affected product;
  • a clear description of the issue;
  • when you first noticed the issue; and
  • clear photographs or video showing the issue where possible.

Photographs allow us to assess the issue quickly, but we may need the product returned for inspection before confirming the available remedy.

10.2 ASSESSMENT

A product is not necessarily faulty merely because:

  • it does not fit as expected;
  • you changed your mind;
  • you selected the wrong size or product;
  • there is a minor colour difference caused by screen display or lighting;
  • there is ordinary wear and tear;
  • the product has been damaged through misuse or accident;
  • care instructions were not followed;
  • the product was altered or repaired by someone else; or
  • you were informed of a specific fault before purchasing it.

We will assess the product objectively and in accordance with the Australian Consumer Law.

10.3 AVAILABLE REMEDIES

The remedy available depends on whether the problem is major or minor and on the requirements of the Australian Consumer Law.

For a major failure, you may be entitled to reject the product and choose a refund or replacement, or keep the product and seek compensation for the reduction in value.

For a minor failure, we may choose to provide a repair or replacement within a reasonable time. If we cannot do so, you may then be entitled to another remedy.

An approved refund for a consumer-guarantee claim will ordinarily be returned to the original payment method. We may offer store credit as an option, but you are not required to accept store credit where the law entitles you to a refund.

10.4 RETURN COSTS FOR VALID CLAIMS

Where a product is confirmed to have a failure covered by the Australian Consumer Law, we will meet reasonable return costs where required by law.

Please contact us before returning a product believed to be faulty so we can provide the appropriate instructions.

11. RETURN PROCESSING

We aim to process returns within two business days after they are received at our warehouse. During busy periods, please allow up to five business days.

Carrier tracking that shows a parcel as delivered does not mean that the return has already been opened, inspected and processed.

Once a return has been processed, we will send confirmation to the email address associated with the return.

Store-credit emails may have a subject similar to “Amaroso Boutique $XX gift card”. Please check your spam, junk and promotions folders before contacting us.

If the email address used to lodge the return differs from the email address used for the original order, there may be a delay or difficulty locating the return. Please provide the original order number when contacting us.

12. ACCOUNTS

You may be able to place an order as a guest or create a customer account.

You are responsible for:

  • providing accurate and current account information;
  • keeping your password and login details secure;
  • activities performed through your account; and
  • notifying us if you believe your account has been accessed without permission.

We may suspend, restrict or close an account where we reasonably believe there has been fraud, misuse, a security issue or a serious breach of these Terms and Conditions.

Closing an account does not remove any rights, obligations or liabilities connected with orders placed before closure.

13. WEBSITE USE

You may use our website only for lawful personal shopping and related purposes.

You must not:

  • use the website for unlawful, fraudulent or misleading activity;
  • attempt to gain unauthorised access to the website, accounts or systems;
  • introduce malware, viruses or other harmful code;
  • interfere with the operation, security or performance of the website;
  • scrape, harvest or extract website content or data without permission;
  • use automated tools to place orders, reserve stock or abuse promotions;
  • impersonate another person or provide false information;
  • use the website in a way that infringes another person’s rights; or
  • assist another person to do any of these things.

We may restrict or block access to our website where reasonably necessary to protect our customers, systems, intellectual property or business.

13.1 WEBSITE AVAILABILITY

We aim to keep our website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may change, suspend or withdraw website content or functionality for maintenance, security, operational or other legitimate business reasons.

13.2 THIRD-PARTY SERVICES

Our website may rely on third-party services, including Shopify, payment providers, carriers, returns platforms, analytics providers and social-media platforms.

We are not responsible for a third-party service being unavailable or malfunctioning where the matter is outside our reasonable control. This does not limit any responsibility we have under applicable law.

Our website may contain links to third-party websites. We do not control those websites and are not responsible for their content, security, availability or privacy practices.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, Amaroso Boutique owns or is licensed to use all intellectual property appearing on our website, including:

  • photographs and product images;
  • videos;
  • product descriptions and written content;
  • graphics, banners and promotional material;
  • logos, trade marks and branding;
  • website layouts and design elements;
  • email and social-media content; and
  • other website material.

You may view and use our website for personal shopping purposes.

You must not copy, download, reproduce, republish, modify, distribute, display, sell, license, scrape or commercially use our content without our prior written permission, except where permitted by law.

In particular, our product images, videos and descriptions must not be used to advertise or sell products on another website, marketplace, social-media account or other platform without our prior written permission.

Permission to use content on one occasion does not grant an ongoing licence or permission to use other content.

We reserve the right to require unauthorised content to be removed and to pursue available legal remedies for infringement.

15. CUSTOMER CONTENT AND SOCIAL MEDIA

If you tag Amaroso Boutique, send us photographs or videos, or otherwise provide content for possible publication, you confirm that:

  • you own the content or have permission to provide it;
  • the content does not infringe another person’s rights;
  • any person shown has consented to the content being shared; and
  • the content is not unlawful, misleading, offensive or defamatory.

We will not use customer content in our advertising merely because you tagged us unless we have permission or another lawful basis to do so.

Where you give us permission to use content, the scope of that permission will be explained when permission is requested.

16. REVIEWS

Reviews must reflect a genuine experience with our business or products.

Reviews must not contain:

  • false or misleading information;
  • personal or confidential information about another person;
  • unlawful, threatening, abusive or defamatory material;
  • content that infringes another person’s intellectual property rights;
  • spam, advertising or unrelated promotional content; or
  • content submitted in exchange for an undisclosed benefit.

Reviews may be subject to the terms and moderation policies of the platform on which they are published.

17. PRIVACY AND MARKETING

We collect, use and disclose personal information in accordance with our Privacy Policy.

Where you choose to subscribe to our email or SMS marketing, including by completing any applicable confirmation process, you consent to receiving marketing communications from us.

You do not need to subscribe to marketing to make a purchase.

You may unsubscribe from marketing emails using the unsubscribe link included in the message. You may unsubscribe from SMS marketing using the instructions included in the message, such as replying STOP where that option is provided.

Unsubscribing from marketing does not prevent us from sending necessary service messages about an existing order, return, account or customer-service enquiry.

18. FRAUD, CHARGEBACKS AND PAYMENT DISPUTES

If you do not recognise a transaction or believe a payment was unauthorised, contact us promptly so we can investigate.

You must not knowingly submit a false payment dispute or chargeback for:

  • an order you authorised;
  • an order received by you or someone at your nominated address;
  • a valid change-of-mind issue;
  • a return that has not yet been received or processed; or
  • a matter that has already been resolved.

We may provide order, payment, tracking, delivery and communication records to banks, payment providers, fraud-prevention services or relevant authorities when responding to a payment dispute or suspected fraud.

Nothing in this section prevents you from exercising a genuine legal right to dispute an unauthorised or incorrectly processed payment.

19. LIABILITY

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

To the extent permitted by law, we are not responsible for loss or damage that:

  • was not caused by our act or omission;
  • was not reasonably foreseeable;
  • resulted from incorrect or incomplete information supplied by you;
  • resulted from misuse, accidental damage or unauthorised alteration of a product;
  • resulted from a failure to follow product care instructions; or
  • could reasonably have been avoided by you taking appropriate steps.

Where products are purchased primarily for personal, domestic or household use, nothing in these Terms limits any right to recover reasonably foreseeable loss or damage caused by a failure to comply with a consumer guarantee.

20. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by an event outside our reasonable control, including:

  • natural disasters and extreme weather;
  • fire, flood or power failure;
  • industrial action;
  • transport or carrier disruption;
  • customs or border delays;
  • government action or legal restrictions;
  • telecommunications or internet failure;
  • cyber incidents not caused by our failure to take reasonable care;
  • public-health emergencies; or
  • supply-chain disruption.

Where an event outside our control affects an order, we will take reasonable steps to minimise the impact and communicate with you.

Nothing in this section limits any non-excludable rights you have under applicable law.

For order enquiries, include your order number. For replacement-order return requests, include both the original order number and the replacement order number.

We may update these Terms and Conditions from time to time to reflect changes to our business, website, services, policies or legal obligations.

The updated version will be published on this page with a revised “Last updated” date.

The Terms and Conditions in effect when your order was placed will generally apply to that order, except where a change is required by law or benefits you.

23. GENERAL

23.1 GOVERNING LAW

These Terms and Conditions are governed by the laws of Queensland, Australia.

You and Amaroso Boutique submit to the jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.

This does not prevent you from exercising any right you may have to bring a claim in another jurisdiction under applicable consumer law.

23.2 SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.

23.3 NO WAIVER

If we do not immediately enforce a provision of these Terms and Conditions, that does not mean we have waived our right to enforce it later.
